Welcome to BioMan Biology and BrainyBlast! These Unified Terms of Service ("Terms") act as a straightforward guide to the rules for using our network websites, shared login architecture, and educational resources. By accessing or using our platforms, you agree to these Terms.

1. Acceptance of Terms

By using BioMan Biology or BrainyBlast—whether accessing our Standard Ad-Supported Versions or our premium Member Versions—you agree to comply with these Terms and our related Unified Privacy Policy. If you do not agree with these Terms, please do not use or access the network sites.

2. Teacher and School Responsibilities (COPPA Compliance)

Our platforms offer optional Gradebook and performance features that allow students to submit game and quiz scores directly to their teachers, as well as safely save their in-game progress to our shared servers. To protect student privacy, we rely on authorized educators to manage this process:

• Authorization: If you are an educator creating an account, you represent and warrant that you are an authorized representative of your school or district. Because our systems share a single database, your account gives you management capabilities across both websites.
• Parental Consent: By instructing your students to use BioMan Biology or BrainyBlast to save progress or submit scores to your registered email address, you confirm that you or your educational institution have obtained any necessary parental consent for the collection of this student data for educational purposes, acting as the parent's agent (in loco parentis) under the Children's Online Privacy Protection Act (COPPA).
• Data Retention & Scheduled Erasure: To fulfill federal data minimization requirements, educators explicitly acknowledge and agree that student submissions, saved lab scores, and platform records are held under a strict rolling retention timeline. All educational score metrics and progress files across both web properties are systematically and permanently deleted from our live servers exactly **six (6) months** following their registration. It is the responsibility of the educator to record and export critical grading outcomes prior to this automatic threshold.
• Account Security: You are responsible for maintaining the confidentiality of your shared password and account information.

3. Intellectual Property

All original content on BioMan Biology and BrainyBlast, including the games, virtual labs, code, graphics, and text, is the exclusive property of our network.

• Permitted Use: You are encouraged to use, link to, and display our resources for personal, non-commercial, and classroom educational purposes.
• Prohibited Use: You may not copy, reproduce, reverse-engineer, distribute, or sell any of our network games, software, or site content without explicit written permission.

4. Acceptable Use and User Conduct

We want our educational properties to be safe, reliable tools for everyone. When using our sites, you agree not to:

• Interfere with or disrupt our website servers or underlying data networks.
• Attempt to bypass any security features, including the AES-256 encryption protecting our Gradebook data.
• Use the sites for any illegal or unauthorized purpose.

5. Memberships and Ad-Free Access

Access to the premium, Ad-Free Member Versions requires a valid, purchased membership.

• Memberships are linked to your unified account and are intended for the purchasing user or their designated classroom. They may not be shared, publicly posted, or resold.
• We reserve the right to suspend or terminate network accounts that violate these sharing protocols or engage in unauthorized distribution of site access.

6. Disclaimer of Warranties

We work incredibly hard to ensure our network represents top-tier educational software, but the internet can be unpredictable.

• "As Is" Basis: The websites and all educational materials are provided on an "as is" and "as available" basis. We do not guarantee that the platforms will be 100% error-free or that access will be continuous and uninterrupted.
• Data Loss vs. Intended Erasure: While we use high-level encryption protocols and secure server architectures to prevent malicious intrusions, we are not liable for unintended data disruptions or accidental data loss. Furthermore, users recognize that the permanent, automated removal of student records passing the **six (6) month retention boundary** constitutes a planned data security protocol and does not qualify as data loss or infrastructural failure.

7. Limitation of Liability

To the maximum extent permitted by law, BioMan Biology and BrainyBlast shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, the websites or their educational resources.

8. Modifications to Terms

We reserve the right to update or modify these Terms at any time to reflect changes in our services or legal obligations. We will notify users of significant changes by updating the "Effective Date" at the top of this page. Continued use of the sites after changes are posted constitutes your acceptance of the new Terms.
